Terms and Conditions
You may use the Homa platform (also referred to as "the site" or "the app" or "HOMA") for personal or commercial purposes, in accordance with these terms of use and the applicable laws in the Kingdom of Saudi Arabia. By accessing the platform or registering on it, you fully and unconditionally agree to these terms and conditions, which will be effective as of your registration date.
The terms of use are subject to periodic updates and modifications by the platform's management without prior notice. Any change to these terms becomes effective immediately upon approval by Homa. Therefore, we recommend you regularly review this page to stay updated. Continuing to use the platform after any modification is considered as your full acceptance of the new changes.
It should be noted that Homa is not obliged to notify users individually of any updates to the terms of use, so the responsibility for tracking these changes lies with you as the user.
1.1 These Terms and Conditions represent a legally binding agreement between you and the Homa platform, governing your use of the website, applications, and related services. Homa allows its users (whether visitors or clients) to search for, choose, and book housing units and various services. In return, the platform provides hosts (or lessors of the units) a way to display their available units and services. Each offer made by the host is referred to as a "Host Listing." It is important to note that Homa does not own, manage, or control any host listings or services provided through them. The platform’s role is limited to providing an electronic space that facilitates communication between guests and hosts, while all obligations and responsibilities arising from booking and services remain strictly between the two directly concerned parties.
1.2 Homa applies additional policies in addition to the basic terms of use, including the privacy policy that outlines how your personal data is collected and processed, and the payment terms governing financial transactions and payments to hosts. These policies are an integral part of the usage agreement, and it is assumed that you have agreed to them by using the platform.
2. Provisions Applicable to Guests:
2.1 As a guest, you can search for accommodations using specific criteria such as the type of housing, city, and stay dates. You can also use filters to refine the search results. The displayed results depend on how well they match the search criteria you set, noting that Homa does not guarantee the alignment of search data with the results. Therefore, we recommend you carefully review the accommodation details before making a reservation.
2.2 Booking Terms: When you complete a booking through Homa, you fully agree to all the booking terms imposed by the host, which may include policies regarding changes, cancellations, no-shows, check-in and check-out times, and any other conditions applied during your stay or booking, including available services and/or products provided by the accommodation (additional terms and conditions set by the host can be found on the unit's page under the booking terms and change/cancellation policy).
3.2 Once you receive the booking confirmation, this means you agree to all its terms. The relationship between you and the host is governed by the policies outlined in the unit's listing, including the cancellation policy and any other terms. We advise you to read these terms carefully before making the reservation, noting that some hosts may work within a hosting team.
4.2 You can modify or cancel the booking through the app by selecting the appropriate option in the booking details page, keeping in mind that some hosts do not allow modifications or cancellations according to their policy.
5.2 If you are delayed beyond the agreed check-in time, please contact the host directly and inform them of the delay.
6.2 If you are unable to access the unit due to personal circumstances, the booking will be canceled without refund, unless the host's policy permits otherwise.
7.2 In the case of cancellation, the refund amount is determined according to the host's specific cancellation and modification policy.
8.2 The booking change or cancellation policy may be one of the following:
- Strict: No refund of the paid booking amount after the guest confirms the booking.
- Moderate: The guest can cancel the booking and receive a full refund of the paid amount before the check-in date, up to 4 days.
- Flexible: The guest can cancel the booking and receive a full refund of the paid amount before the check-in date, up to 2 days.
- Free: The guest can cancel the booking and receive a full refund of the paid amount before the check-in date (11:59 PM).
We recommend reviewing the cancellation policy for each unit before making a booking.
3. Cancellation of Reservation:
1.3 The guest is required (upon booking confirmation) to pay the deposit amount (if applicable) or the full value of the reservation.
2.3 Please note that some bookings made at special prices, promotional offers, or with discount codes, may not be eligible for changes or cancellations.
3.3 Some accommodations may apply additional charges for late check-out and early check-in, according to the host’s policies.
4.3 The booking change or cancellation policy for the accommodation can be viewed on the accommodation's information page on the website.
5.3 Before booking, please ensure you review the host's terms and the booking change or cancellation policy, and read the no-show policy of the accommodation listed on the unit's page before finalizing your booking. If the guest fails to check out on time, Homa and the unit lessor have the right to charge the guest for the full cost of the late night.
6.3 If you wish to review, modify, or cancel your booking, please refer to the "My Bookings" section on the app and follow the instructions there, or contact Homa's customer service team via the platform's chat feature.
4. Compensation for the Guest in the Following Cases, at Homa's Sole Discretion:
- The booked unit is unfit for use.
- Essential facilities advertised for the booked unit are missing or unfit for use. This includes, but is not limited to, discrepancies in the number of beds or rooms, unfit sanitary facilities, etc.
- The booked unit is not clean as per the standard norms.
- The host refuses to hand over the booked unit for an unlawful reason.
1.4 If any of the provisions in section 4 apply, the guest must submit a report within one hour of entering the unit.
2.4 In all cases, the compensation amount will not exceed the amount paid by the guest.
5. Disclaimer of Warranties:
1.5 We do not guarantee the availability of all requested facilities in the booked accommodation.
2.5 We recommend that you always run an antivirus program on any files downloaded from the internet. Homa is not responsible for any loss, interruption, or damage to your data or device, or any device used to browse the platform, that may occur while accessing the platform.
3.5 The use of the platform is at your own risk, and we are not in any way responsible for any loss or damage of any kind that may occur due to your use of or visit to the site, reliance on any statement, opinion, or advertisement on the site, or any delays in operation, connection failures, or difficulties accessing the internet, equipment failures, software malfunctions, or the behavior or thoughts of anyone accessing the platform. The platform is also not liable for any damages arising from natural disasters, or any issues resulting from dealings with the host or others, loss or damage to property, or any other physical injuries to the guest. By using this platform, you acknowledge and agree that your exclusive remedy for any damage or loss arising from your access or use of the site is to stop using or accessing the site, or not continue using it.
4.5 Homa makes every effort to provide continuous service, but cannot guarantee that the platform will operate without any interruptions.
6.5 Homa is not responsible for the loss, damage, or theft of personal property in any way. Additionally, Homa is not liable for the safety of the booked unit or any damages that may occur to the guest, such as drowning, for example.
6. General Provisions:
6.1 At the end of the stay period, both the guest and the host have the opportunity to rate the experience with the other party. We emphasize the importance of keeping these reviews honest and realistic, and ensuring no inappropriate, discriminatory, or defamatory language is used, in accordance with the laws of the Kingdom of Saudi Arabia. It should be noted that the platform does not review ratings beforehand to verify their accuracy, meaning some may be inaccurate or reflect personal opinions.
2.6 By using Homa personally, you agree to the following:
3.6 You acknowledge that you are 18 years old and have the full legal capacity to create contractual obligations.
4.6 The host has the right to only hand over the unit to the person named in the booking, and may verify the booking details, such as ID, passport, residency number, mobile number, and date of birth.
5.6 No fictitious, speculative, or preparatory bookings may be made, and Homa has the right to cancel, without prior notice, any bookings made to multiple parties for the same date.
6.6 Do not alter or modify the frontend appearance of the site or the core application.
7.6 Do not perform any action that may cause excessive or disproportionate pressure on the site, application, or its infrastructure.
8.6 It is your personal responsibility to comply with all our terms and conditions, which include, but are not limited to, full payment of due amounts on time, adherence to all price policies, fees, service and product terms, and platform regulations.
9.6 Do not perform any actions that may harm, conflict with, or disrupt access to the site or the availability of its content. Do not upload any files containing viruses or other harmful code, or programs intended to intercept, destroy, or limit the functionality of the site or application.
10.6 Any activity involving the publishing, distribution, or uploading of inappropriate or illegal materials via our platform is prohibited, including offensive, discriminatory, threatening content or any content that violates others' rights or contradicts public ethics. Mass unsolicited emails or random promotional materials (spam) are also strictly prohibited in any form, whether through email or systems tracking Homa.
11.6 Any behavior involving threats, harassment, abuse, or annoyance towards any user, or any act that violates the rights and freedoms of others, is strictly prohibited.
12.6 Do not attempt or gain unauthorized access to the site or any member account on the site, or impersonate or alter membership information of another person.
13.6 Do not cause or allow the violation of intellectual property rights belonging to the platform, its affiliates, or any other parties.
14.6 Do not engage in any illegal activities that may impose any legal liability on Homa.
15.6 Do not violate this agreement or any applicable law or regulation.
16.6 Do not upload or attach files or software that are protected by intellectual property rights unless you have the proper usage rights or legal authorization.
17.6 Do not upload files containing viruses or malicious software that may affect computer systems.
18.6 Do not remove or alter copyright or legal notices, or intellectual property rights notices from any uploaded files.
19.6 Do not falsify the origin or source of any software or materials uploaded.
20.6 Do not advertise, offer to sell, or send unsolicited surveys, competitions, chain letters, or upload any files shared by another user, and be aware that such promotion is legally prohibited.
21.6 Do not use the site, application, or their contents for any purpose other than their intended use.
22.6 Do not gain unauthorized access to or monitor, copy, or track any content on the site by any means (electronic or manual) without written consent.
23.6 Do not violate restrictions on the site or the application, or bypass or circumvent other measures used to prevent or restrict access to the site.
24.6 Do not take any action that may impose an unreasonable burden on the site’s or application’s infrastructure.
25.6 Do not create deep links to any part of this site for any purpose without our explicit written permission, or integrate any part of this site into another website without prior written consent.
26.6 Do not add, display, upload, modify, publish, transmit, update, or share any unwanted information that causes significant harm, invades others' privacy, is racist, violates patents, trademarks, copyrights, or any other intellectual property rights, misleads or deceives the recipient, threatens the unity, security, or friendly relations with foreign countries, or incites crime, prevents the investigation of any crime, insults another country, impersonates someone else, or involves information related to another person that the user has no right to hold.
27.6 The terms and conditions are subject to the laws of the Kingdom of Saudi Arabia and shall be interpreted in accordance with them. The exclusive jurisdiction for any legal disputes shall be with the courts in the Riyadh region.
7. In the event of a violation of the terms and conditions of use, Homa reserves the right to take the following actions:
1.7 Warn and notify you of the violation committed, with the right to demand immediate compliance with these terms.
2.7 Remove any materials or content posted by you that violates these terms without prior notice.
3.7 Take measures (including suspending, restricting, or terminating access) and prevent you from using Homa. This includes banning the guest from renting properties from a particular host or from using the platform in general.
4.7 Cancel any of your bookings and your account, as well as any other bookings or accounts associated with you, if the platform determines that you are in violation of these terms and conditions.
5.7 Report your activities to internet service providers or relevant authorities.
6.7 Take legal action and seek compensation from you.
8. Copyright and Trademarks:
1.8 All content on the application and materials available on it are protected by copyright and intellectual property laws.
2.8 The application is available for personal use only. You are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, create derivative works, transfer, or sell any information, programs, products, or services obtained from the site.
3.8 The names and titles "Homa" and its partners, as well as all logos and trademarks associated with them, are the exclusive property of the platform. Other trademarks mentioned in the application and on the website are the property of their respective owners and may not be used in any way without prior written consent from the owners.
9. Compensation and Liability:
1.9 In addition to any other compensation stated in these terms and conditions, and as a condition of using the application, you agree to indemnify us for any liabilities, losses, claims, expenses (including legal costs), and damages (whether direct or indirect) arising from claims resulting from your use of the application, including and not limited to any claims involving disputes that are verified and represent a violation of these terms by you.
2.9 If a guest causes damage to the host’s unit, regardless of the type, the guest is obligated to compensate the platform for the amount of the compensation in the host protection program, in addition to compensating both the platform and the host for such damages.
3.9 Homa determines the value of these compensations and will provide the guest with details of the amounts for these claims upon the guest's request.
4.9 The guest is obligated to pay the compensation via the link sent by Homa within the specified time in the SMS message. If the platform does not receive the compensation, the guest's wallet balance will go negative, and no bookings will be accepted from the guest until the compensation is paid. Homa reserves the right to claim the compensation through legal means if the guest fails to pay within the specified time.
10. Final Provisions:
1.10 The guest must provide a copy of their passport, residency, or national ID, along with their data, birthdate, email, and mobile number on the account creation page so that the platform can verify the accuracy of the information. The platform will send a confirmation number via email and mobile to verify the information.
2.10 The platform does not assume responsibility for the accuracy of the guest’s data, and the acceptance of the guest’s data does not imply a guarantee of its accuracy or validity.
3.10 If the platform or the host determines that the data entered is incorrect or if the guest does not comply with the published terms, the host and the platform have the right to block the guest from using their services and cancel the booking, unless it is proven that the guest is the owner of the data and it is correct.
4.10 The guest acknowledges that they have read the host's booking terms and conditions, these terms and conditions, and the privacy policy, and agrees to them. The guest guarantees full compliance with these terms, conditions, and the host's policies.
5.10 The guest agrees to communicate with Homa and receive notifications via email, app notifications, and text messages. These notifications include promotional messages, service offers, and booking details.
6.10 If the host requests a security deposit, the guest is obligated to pay the deposit upon arrival and before receiving the reserved unit according to the host's conditions. If the guest returns the property in good condition, the host is obligated to return the security deposit after verifying the condition of the unit before the next scheduled arrival. The host waives the deposit in case of any damages to the property.
7.10 If the guest does not follow the booking conditions or causes damages, the host has the right to request the guest's details to report to the authorities, and Homa disclaims responsibility for their accuracy.
8.10 The scheduled arrival date refers to the fixed time set by the host for receiving the unit.
